The suit, filed in Los Angeles federal court by an unnamed aspiring actress who claims Weinstein harassed her in a building occupied by his former company, Miramax, also names The Weinstein Co.as a defendant and accuses its leadership of being complicit in Weinstein's systematic harassment and abuse of women.
Noble tried to stop Weinstein's advances but to no avail she claims, as the executive 'forced his leg between Kadian's legs, began rubbing her vagina, and then took his penis out and began masturbating'.
"Kadian has suffered severe injuries and emotional distress, pain and suffering, mental anguish, inconvenience, loss of capacity for the enjoyment of life, inability to lead a normal life, shame and humiliation", lawyer Stuart Mermelstein writes.
"Harvey Weinstein was able to force or coerce Kadian into sexual activity in his hotel room because of his promise to her of a film role and use of his influence on her behalf", states Noble's 11-page federal complaint, filed Monday in the U.S. District Court for the Southern District of NY. An excited Noble, eager to share her show reel with Weinstein, brought her iPad along as the two went upstair.
The alleged assault occurred in May 2014 in Cannes, France according to the lawsuit.
"The reason why I said nothing for so long is I thought if I ever wanted an opportunity in this industry, how would small me speak of this man saying he's been inappropriate with me, people look at me like who the hell is this girl to say this about this god or powerful influence", she told reporters.
Marouane Fellaini OUT of Man Utd clash at Watford - journalist
Watford looked promising going forward in the opening stages, clearly not content to sit back and let United do all the attacking. No punishment from the FA for Romelu Lukaku following the "incident" during the Brighton game.
The suit argues that Harvey Weinstein groomed Noble overseas, and used "force, fraud or coercion" during his sexual encounter with the actress.
"TWC employees knew to "take care" of the FOHs". She is also suing Bob Weinstein - Harvey's brother - and the Weinstein Company for allowing Harvey Weinstein to continue with his alleged assaults for years even after others raised concerns with his behavior over the years.
Weinstein "blocked her exit" next according to court papers and 'pulled down Kadian's shirt, revealing her breasts, and unbuckled his trousers and belt'. "Harvey Weinstein ultimately forced Kadian into sexual acts", the 11-page complaint states.
The company violated USA sex trafficking law by "benefiting from, and knowingly facilitating, the venture in which Harvey Weinstein traveled in foreign commerce to recruit or entice female actors into forced or coerced sexual encounters on the promise of roles", states the lawsuit.
As for Weinstein, he is under investigation by police in New York, Los Angeles, Beverly Hills, and the United Kingdom for multiple sexual assault charges.
